    摘要:

    甲骨文中有〖XC1.tif〗(道)字。“道”字本义:人在超越私而天人相通、天人合一时,所明白的宇宙真谛。老子之“道”可比拟为:真道生妙无,妙无生神明,神明生理念,理念生规律,规律生万物。中国法律理想图景可从中受启迪,从“现代化范式”及其“逻各斯中心主义”向去蔽之“道”之真精神转化:在“逻辑与直观统一”精神下之法律文化,既主张法治的实现,又使西方逻各斯中心主义的理性至上与传统中国逻辑缺乏导致的主体精神缺失的毛病皆得到克服。“道”包含“法自然”与“自然法”两重意境,则可通过把形上之“道”作为终极价值诉求,把更

    Abstract:

    It exists symbol of (DAO) inscribed on oracle bonesOriginal meaning of symbol of DAO : When Universe and Human is One, man understands the true essence of the universe。Path of China law’s ideal prospect get enlightenment from it. From “modernization paradigm”and its philosophy foundation of “Logoscentrism” into “true spirit of DAO”,it has been sheltered so long, Under unified in logic and Intuitive spirit,both not object the realization of the rule of law realizes, but also the supremany of rationality of Logoscentrism of Western, the problem of absence of spirit of subject which caused by the lack of logic of the lack of traditional Chinese have been overcomed respectively. So DAO contains double conception of “Imitate nature”and “nature law”,which can make Metaphysical “DAO” as critical demands of the ultimate value, by relatively easier to grasp the “reason” as appropriate standards or, when the law has not expressly provided “Discretionary power”, sublimation of the effectiveness of law and pursuit of value
