    摘要:

    检察机关提起公益诉讼的核心问题是权力属性及职权配置的宪法问题。立足于中国特色社会主义检察机关的宪法定位与检察监督制度发展的历史经纬,检察机关提起公益诉讼的权力属性不是法律监督权的宽泛解释,也不是诉讼监督权的自然延伸,而是检察机关通过提起诉讼的方式行使一般监督权。检察监督的改革创新为一般监督权的续造提供了新的契机。而权力属性为一般监督权的定位也为检察机关提起公益诉讼的职权配置,尤其是在监督方式、监督程序以及监督内容的制度设计上提供了新的路径。

    Abstract:

    The core issue on public interest litigation instituted by procuratorate is a constitutional problem about the features and distribution of procuratorial power. Based on procuratorial power's position in Constitution of the People's Republic of China and process of development and transformation for procuratorial supervision system in China, the features of procuratorial power to bring public interest litigation is neither an excessively broad interpretation of legal supervision power nor an extension of litigation supervision power, but the exercise of procuratorate's general supervision power. The reform and innovation of procuratorial supervision creates a new opportunity for resurrecting and updating general procuratorate's supervision power. Featured as general supervision power, procuratorial power to bring public interest litigation can be distributed more appropriately. Because of this, system design in supervision way, supervision process and supervision content will be more proper.
