我国建设用地的土地使用权获得有两种方式:划拨和出让。出让土地使用权是市场经济的产物,适合市场的发展,但也存在着根本性的弊端和自身无法解决的问题。划拨土地使用权虽然存在不少弊端,但也有其他制度无法替代的优点。对这两,不应是一存一废,而应是予以完善,充分发挥各自最大的优势。
