科技创新已经成为国家间竞争成败的分水岭,知识产权工作是科技创新的重要组成部分，有效利用知识产权才能增强自主创新能力，才能促进产业发展，提升国家的综合国力。改革开放30多年来,国家高度重视科技创新，但是多年来，我国采取跟踪模仿模式,发展始终受限，不能为国民经济和社会发展提供强大支撑作用。文章重点分析了我国科技创新中存在的知识产权问题，并设计出了较为系统的知识产权政策与制度建议，对国家科技创新能力的提升和国家整体综合实力的增强有着重要的现实意义。

Technology innovation is important to the national competition, intellectual property rights is an important part of technology innovation. Intellectual property rights used effectively can improve the ability of independent innovation, promote the development of industry, and enhance the national power. Chinese economic reform for 30 years, we’ve treasured technology innovation, but with some reasons the development was slow. The paper analyzed the problems about intellectual property rights in technology innovation, pointed out the suggestion of intellectual property rights policy. It is important to improve the technology innovation ability and enhance the national strength.
