For that reason, in the new energy sources context, this paper employs evolutionary game theory to build evolutionary game model of investment and financing mechanism of new energy sources, pays a greatly attention to analyzing the factors affecting strategy selection of each game subject in order to explore evolutionary stable strategy. The dynamic evolutionary process in different initial state is examined with the aid of numerical analysis. In addition, this paper puts forward a series of policy suggestions in new energy sources development.

Abstract:This research proposes the analysis framework of three-dimensional market structure-“scale structure, industry structure and professional structure” from the system angle, and provides new idea to comprehensively and systematically analyze the development of specific industry. Besides, it is applied to Chinese construction industry. Based on the data from China Statistical yearbook(2001-2010) and China construction Statistical yearbook(2001-2009), this paper analyzes the evolution trend of scale, industry and professional structure of Chinese construction industry. The research finds that: from the angle of scale structure, the enterprise scale in Chinese construction market is not exactly the same during the ten years, but the degree of change is relatively stable, which represents the situation that “it is main in the competition, as well as local monopoly”; from the perspective of industry structure, there are a great deal of enterprises in housing construction industry with a relatively small scale, and the market competition is strong. Compared with it, the departments in civil engineering industry are heavily protected and the degree of market competition is smaller; from the view of professional structure, there is unbalance between the general contractor and professional contractor. The number of the general contractor enterprise is excessive and the scale is big, while the structure distribution of the specialization enterprises is unreasonable. The general contractor enterprise and professional contractor enterprise haven’t built a perfectly collaborative relationship.

      2014, 20(2):64-72. CSTR:

      Abstract (976) HTML (369) PDF 2.13 M (2310) Comment (0) Favorites

Abstract:Determining the winning bidder of some major or technically complex government project is not only the price, bat also the quality and duration etc. So, the paper regards the selection process of government project tenderee and bidder as a three-stage dynamic game of offer, commitment and evaluation, and to build a non-cooperative and dynamic game model based on multi-attribute government project bidding, and then to consider the price of a function of quality and duration, to find out the optimal bidding strategy of bidder. The analysis turns up that the quality and advanced time respectively after reach one point, the bidder’s earnings are a rise function of quality and advance time, and then the bidder’s earnings would be a decrease function if it before reaches the point. The bidder’s earnings would be much more if the preferences coefficient is much greater of quality and advance time by which tenderee promises, so to gain more bidding surplus, the tenderee would exaggerate the preferences coefficient of quality and advance times. At last, this paper verifies the validity of the model by using examples.

      Abstract (1043) HTML (375) PDF 1.87 M (885) Comment (0) Favorites

Abstract:The patent law modification draft was released for public comment by the State Intellectual Property Office on August 9, 2012.As one of the bright spots, the rules of the punitive damages is concerned by all sectors of society. Some people approve of it, and others oppose it. At present, Chinese courts generally apply the compensatory damages to patent infringement compensation through empirical investigation, which is difficult to adapt to the modern complex infringement. However, the punitive damages which make up for the defect of compensatory damages, can protect fully the legitimate rights and interests of the patentee, impede patent infringement and encourage law-abiding behavior. The development of modern tort liability law provides a theoretical basis for the punitive damages. According toChina's realistic national condition, we can deliberately introduce the punitive damages to the patent infringement at present. But we should restrict the applicable conditions and the amount of damages, make the standard of compensation in details. The punitive damages article of this draft has yet to be perfected.

Therefore, the claims arising from mass torts upon persons shall be treated equally as laborer’s claims through judicial interpretations.
