Abstract:The government has given the priority to the west of China in launching the fiscal transfer payment,reflecting on the Grand Western Development Programme. Such priority has also been provided to support some particular business and social proprammes from that area,aiming at achieving a balanced development. Between 2001 and 2012,per capita GDP and HDI of different districts were generally used as the key criteria to evaluate the gap of economic and social development within China; as the variables of fiscal transfer payment is introduced as a key criteria,it is found that the corresponding β convergence exists,indicating that convergence rate of HDI is much greater than that of economic growth. The gap between the east and the west has been narrowing,particularly in social development. It is therefore proved that the fiscal transfer payment has efficiently minimized the gap between the west and the rest of China in development and human development.

Abstract:The development of China's service industry is inseparable from the realistic background of urbanization currently.Choosing the panel data of twenty-six provinces,autonomous regions and municipalities of China from 2005 to 2015,this paper makes an empirical study on the impact of urbanization on the development of service industry and its regional difference separately by using dynamic panel model of system GMM estimation method.The result of study shows that urbanization has a significantly positive impact on the service industry at the national level,while the promoting impact is still small; the impact of urbanization of the east,middle and west of China on the service industry are also small and significantly different at the regional level.Based on the results of empirical study,this paper puts forward relevant suggestions that accelerating the process of a new type of urbanization should be attached importance to at a strategic level for the better development of China's service industry and appropriate policies and measures to promote the development of service industry with urbanization should be formulated according to the actual situation of each region.

Abstract:Under the circumstances of new situation and new finance,new contradictions and problems arise accompanied by innovation and entrepreneurship,which make it necessary to explore the impact on household entrepreneurship of mainstream and non-mainstream finance from the new perspective of financial inclusion.Binary response models reveal inducing factors and their marginal roles to agriculture and business entrepreneurship,whereas multinomial response model gives us a clear picture of incentives of each start-up and main factors affecting each initiative.The empirical analysis shows that,"no other choice","making fortune","entrepreneurship drive","freedom & flexible" and other causes of entrepreneurial responses' to various explanatory variables are different. Key variables,household characteristics and regional characteristic variables result in different regression coefficients and relative risk ratios. Studies have shown that mainstream finance has a leading role and significant contributions to household entrepreneurship. Under the new financial situation,the rise of Internet finance inducing non-mainstream finance is playing a part in business establishment. Our main goal is to realize coexistence of mainstream and non-mainstream financial systems in mutual-benefit ecological environment. According to different regions,industries,entrepreneurial preferences and incentives,different schemes should be made and the relative supporting measures should be taken.

Abstract:Property income has become a significant factor to widen the gap between the rich and the poor in China. As one of the main redistributive tools,tax policy of the property income should be designed effectively to readjust excessively high individual income. This paper innovatively introduces personal capital productivity to describe the capital accumulation of different people and corresponding potentials of capital gain. Meanwhile,this paper uses political inequality to reinvestigate the Meltzer-Richard model of equilibrium tax rates,and develops a theory that links higher capital productivities to higher social status using one privileged and one non-privileged group as examples. The experiment varies the converting rules used to decide the implemented tax rate. We find that our revised model fits the data better and conforms to the external validity better. This paper provides a possible explanation for the failure of the current redistributive policies. Overweighting the demand of the privileged group will lead to lower property income tax rate,which is in contrast to the policy intention. However,there is also a tradeoff between fairness and efficiency,higher tax rate reduces the overall capital output.

Abstract:Whether liquidity is able to stabilize the market or to bring the crisis to the market? The paper discusses,from the perspective of stock price crash risk,the relationship between stock liquidity and stock price crash risk. We conclude that:the stock liquidity may promote the stock price crash risk,and thus does not play a role in stabilizing the market. Subsequently,the paper discusses the influence mechanism from the "governance theory" and "short-termism theory". We conclude that:when the duality exists,the proportion of independent directors is low,the proportion of short-term institutional investors is higher,the positive relationship between stock liquidity and the stock crash risk is more significant. The conclusions enrich the literatures of stock liquidity and stock price crash risk,and discuss the influence factors of stock price crash risk from the micro perspective.

Abstract:This paper studies the relationship between managerial power,internal control quality and earnings management. We find that:1) The internal control quality is negatively related to earnings management. 2) CEO's structure power plays a negative moderating role in the relationship of internal control quality and the accrued earnings management,which demonstrates the CEO acted as board of director increases the agency costs between shareholder and manager.3) The expert power has a positive moderating effect on internal control quality and the accrued earnings management,which means the CEO's longer tenure can enhance the internal control quality's inhibition effect on the accrued earnings management. 4) The reputation power has a positive moderating effect on the relation of internal control quality and the accrued earning management,which means the higher education background of CEO is favorable of improvement of internal control quality.

Abstract:The weakness and dislocation of performance evaluation has restricted the development of academic innovation team of humanity and social science (AITHSS) in universities. Based on the team performance management theory,considering the academic attribute and development law of humanity and social science,this paper summed up the IMO model of team performance evaluation,distinguished the key performance elements and constructed the performance evaluation index system of AITHSS. The performance evaluation index system,which included three 1-class indexes,fifteen 2-class indexes and fifty 3-class indexes,could be a useful policy tool for strengthening the AITHSS's construction in Chinese universities and the prosperity of philosophy and social science.

Abstract:This paper systematically reviewed the research status of ESI discipline at home and abroad. By the bibliometric analysis of the papers with ESI discipline as the theme published in the CNKI core journals from January 2003 to June 2017,the following problems were found in the research field:the number of papers increased every year but still not enough,the distribution of journals and institutions was not reasonable,the author's professional structure needed to be optimized,the core authors group had not yet formed,discipline ranking and first-class discipline construction were the focuses of research,the research subjects were mostly application countermeasures while basic research papers were very scarce. To solve the above problems,some concrete improvement measures were put forward.

Abstract:The particularity of worker protection should be taken into consideration when a written labor contract is made and entered into. Whether a judge may decide a case on the basis of the text of labor contract is the methodology of judging the parties of the contract have performed the statuary duties under contract. Essential clauses of different nature are vital to the judgment differently. Where a contract is lack of personal information of the parties,work locations,job descriptions,time limit for the labor contract,remunerations and other essential clauses,it should be decided as the parties should bear liability for the failure of performance of the statuary duties stipulated in the written contract. Lacking clauses regarding work hours,break time,and vacations should be deemed as remediable clauses. A contract has no declarative clauses regarding employment protection,work conditions,and protection against and prevention of occupational harm should be regarded that a written labor contract has been concluded. Unless otherwise specified by law,in the event of a labor contract lacking of essential clauses signed by both parties,it is still legally binding on both parties,which should not be regarded as invalid clauses,but rather the basis for judgment.

Abstract:In China,the legal attribution of the monopoly of banking industry lies in the alienation of the rights of the market subjects. The power intervention in the banking industry objectively forms the market barrier,and leads to the tendency of power transition of the market subject's rights. In the process of financial marketization,the banking industry faces the conflicts of rights in the vertical and horizontal dimensions. The rights of competitors and consumers face different degrees of monopoly. The marketization development of the banking industry should be based on the remodeling of market main body's financial development rights,and explore a right-type anti-monopoly regulation aiming at the existing conflict of rights under the double structure of competitor market and consumer market. The "entity" and "focus" of the regulation goal in the context of right is also conducive to promoting the marketization of the banking industry through the development of anti monopoly regulation.

Abstract:In big data era,data has become a key element in social production and economic development,and there is enormous potential value in personal information in improving government decision-making,enterprise's precision marketing,innovation of social management and so on. Globally,the legislation of personal information protection law represented by the European Union has become the mainstream practice in the international community. As for the definition of personal information,the international community has basically formed an approach based on identifiability. But the dynamicity and contextual nature of the definition of personal information not only leads to the difficulty of judicial application,but also makes the enterprise not be able to deal with the problem of anonymization appropriately. In order to make up for the inherent defects of personal information definition,it is necessary to take full advantage of foreign legislation,strengthen the top-down design of personal information rights and construct a prior consent,risk evaluation and case-based mechanism,which constitute the proper meaning of promoting the rationality of civil code and personal information protection law in the future.

Abstract:Russian Personal Data Act is based on European Convention on the Protection of Natural Persons in the Processing of Personal Data,for the purpose of protecting the rights and freedom including the right of privacy of persons and citizens in the processing of personal data,and is applicable to all personal data processing including non-automated personal data processing. The most distinctive feature of its legislation is that the maximum length of the provisions is about obligations of personal data processing person in order to protect the realization of the personal rights of the main body. At the same time,it clearly defined that Russian citizens' personal information must be preserved in the Russian territory,and a system of personal data specialists should be established in the processing person as a legal person. In the area of national supervision,it established a non-independent administrative organ model of the main body for the protection of subjective rights of personal data,rather than following the European model of independent personal information protection agencies.

Abstract:The concepts of personal information and personal data have no significant difference,while there is a huge distinction between the concepts of personal information and personal privacy. Article 76(5) of the Cybersecurity Law takes the name of personal information and defines personal information in the form of "identification type" and "generalization & enumeration type". This definition should be broadly interpreted. Specifically,personal information has two elements,which are "identification" and "record". "Identification" is a substantive element,to be combined with the criteria for judgments,the relevance of information,the possibilities of identification. "Record" is a formal element,and unrecorded information is not personal information.

Abstract:With the arrival of the big data and cloud era,people from real space extend to pseudo space. Pseudo space is a virtual space of symbolic and mimetic,which has profound influence on people's "conceptual world" and "conscious world". The network pseudo space has the duality of "uncontrollability" and "controllability". Abstract:With strong unpredictability,social security incidents have been ineffectively managed by conventional prediction methods. The "scenario-response" model has become an effective method of emergency management dealing with social security incidents in universities and colleges. Therefore,it is of importance to study the mechanism and process of scenario evolution. In this paper,the authors conducted structural description on emergencies' framework based on multidimensional arrays,analyzed the dynamic factors,internal mechanism and explicit mode of the scenario evolution,and then carried out research on the status and result of scenario evolution and development of the social security incidents in universities and colleges under multi-scenes with the example of a certain group conflict. The research showed that:social security incidents in colleges and universities are strongly situation-dependent. The strong correlations between various scenario subjects,scenario elements and scenario chains of different incidents form different scenario evolution. The paper put forward rational proposal for universities and colleges to respond to social security incidents,and provided theoretical support for the construction of emergency preparedness system for incidents.

Abstract:The targeted funding model of universities is a concrete practice that embodies the idea of "targeted poverty alleviation". It provides new method and concept to enhance the accuracy of universities' poverty alleviation. Big data technology has significant advantages for the collection and analysis of information,which will be effective to provide adequate information for sponsors,to provide evidences of facts for diversified forms of poverty alleviation,as well as to provide technical conditions to improve effectiveness. In order to achieve the goal of optimizing targeted funding model of universities,under the guidance of the system theory,it should focus on the integrity of the system,and emphasize the internal coordination. The paper constructed a frame and made institutional innovation in four fields,including framework design,system guarantee,technical path and linkage mechanism.
