    • Study on spatial pattern and formation mechanism of urban contraction in Chengdu-Chongqing city cluster

      Abstract:Based on the fifth and sixth census data, this paper takes 16 prefecture-level and above urban administrative units in Chengdu-Chongqing city cluster as the research object, and conducts comprehensive calculation and analysis of their shrinking spatial pattern, basic features and formation mechanism. The results show the following:1)13 out of the 16 cities of Chengdu-Chongqing city cluster are contracting, accounting for 81.25% of the total urban area, mainly concentrated in the central region of Chengdu-Chongqing city cluster. Three of them are in a non-shrinking state, accounting for 18.75% of the total urban population, and they mainly distribute on both sides of the urban agglomerations. The shrinkage of 14 municipal districts accounted for 29.79% of the total. The contraction phenomenon occurred in 64 city jurisdiction counties, accounting for 65.98 percent of the total number of cities jurisdiction counties. 2) The overall type of shrink city can be divided into three major types:global contraction, marginal contraction and local contraction. The global contraction includes 5 cities, accounting for about 38.46% of the total contraction cities, all located in the central part of Chengdu-Chongqing city cluster and showing continuous development trend. The marginal contraction mainly includes 4 cities, accounting for 30.77% of the total contraction. Local contraction mainly includes 4 cities, accounting for about 30.77% of the shrinking cities, mainly distributed in the central marginal region of Chengdu-Chongqing city cluster, non-shrinking municipal districts (counties) are surrounded by shrinking towns.3) The number of young children and working-age people has been decreasing, the number of the elderly population has been increasing and the burden of social support has been increasing; The population of education showed a trend of continuous increase, and the proportion of people with bachelor's degree or above increased significantly. The proportion of the employed population in the primary industry has declined dramatically, while that of the employed population in the secondary and tertiary industries has increased significantly, and the proportion of the employed population in the secondary industry has increased the most. 4) Based on the analysis of the formation mechanism of urban shrinkage, the central city's siphon effect, the lack of employment in the transformation of industrial structure, the increasing aging trend of population, natural factors and the appropriate interventions of the government constitute the key mechanism of urban contraction of Chengdu-Chongqing city cluster.

      Abstract:Post disaster reconstruction is an important job to ensure the return to normal production and life of the people in the earthquake stricken areas. So, how to measure the performance of post disaster reconstruction? Which factors will affect the performance of post disaster reconstruction? This paper reviews the related literature on performance of post disaster reconstruction. On this basis, this paper argues that the effect and efficiency are two major aspects of the performance of post disaster reconstruction. So, using the time spent in eliminating the impact of disasters and returning to the pre disaster level as standard of measuring the reconstruction performance can reflect the reconstruction effect and efficiency. It has feasibility. Based on this, this paper establishes an analytical framework and measurement method for post disaster reconstruction performance. Taking the Wenchuan earthquake, the Yushu earthquake and the Lushan earthquake as the cases, the paper compares and analyzes the reconstruction performance of the three earthquake stricken areas, and briefly analyzes the reasons for the performance differences. The results show that the three earthquake reconstruction basically completed the goal of post disaster reconstruction on schedule, but because of the different degree of disaster, different quality of reconstruction after disaster, there are some differences in the performance of the three post-earthquake reconstruction.

      Abstract:To construct the public opinion risk assessment system for earthquake disaster network, the paper puts forward the risk assessment method of the public opinion of Accelerating Genetic Algorithm BP neural network (AGABP) for earthquake disaster after the public opinion monitoring index is built. According to the evolution theory of network public opinion, the paper focuses on the physical and social attributes of the earthquake disaster network public opinion, and puts forward earthquake disaster Internet public opinion risk monitoring indexes of 2 dimensions, 4 indexes of second-level and 10 indexes of third-level. According to the disadvantage of the conventional evaluation system for nonlinear, high dimension and non-normal evaluation problem, this paper makes use of the advantage of BP network, which can approximate any nonlinear continuous function with arbitrary precision. The paper uses BP network for evaluating the risk of earthquake disaster network public opinion, and also uses Accelerating Genetic Algorithm (AGA) improving the shortcoming of BP to solve the problem of slow training and premature convergence in conventional BP networks. The paper uses random sample data to carry out self-learning training for AGABP model and verifies it with actual sample data. The research results show that:AGABP model has obvious advantages in convergence speed and accuracy to compare with BP neural network and logistics curve, and can be applied to risk management practice of earthquake network public opinion.

    • An outline of the research on housing consumption in China

      Abstract:The study of housing consumption in China requires great courage to understand the real world sufficiently. The question is not a simple economic proposition,which can generalize all of them, we need to find the expectation theory. With the help of the theory research (an innovation mechanism designing), let the residential consumption return to normal as an opportunity to promote the rational consumption, let the return of housing to meet the people's need to become living place. Price and the market play a role in the housing market, which is the inevitable result pushing forward the marketization process, also is the ultimate goal eliminating over housing market (speculative) (paying more attention to establishing the fair and harmonious society), which makes the housing market return to equilibrium running smoothly. The key of research is to find empirical evidence required the construction of a fair society, beyond the monetary economic housing understanding, and how to plan new initiatives to crack the urban-rural dual economic imbalance problem of the fictitious economy and real economy because of the housing monetization, and to resolve the practice problem that it would be difficult for the government to use regulation policies as a placebo.

    • The dynamic correlation and risk spillover effect of real estate and banking in China: An empirical study based on GPD-Copula-CoVaR model

      Abstract:Based on the GPD-Copula-CoVaR model, this paper investigates the dynamic correlation and risk spillover effect between real estate and banking, over the period 2000 M01-2017M06 in China. In addition, we examine the forecast effect through Monte Carlo method. The results show that the correlation between real estate and banking is highly related to the prosperity and political policies of the real estate market, and the correlation is higher when market in slump. The GPD-BB1 Copula model is suit for the risk situation. The out-of-sample forecast shows that GPD-BB1 Copula model coverage of the actual risk loss is higher, so the prediction ability is better. In addition, the two marks have bidirectional risk spillover effects in extreme situation, and real estate on the banking's spillover is stronger, about 40%. This article provides an effective method for measuring the risks associated with banking and real estate in favor of authorities for risk management.

      Abstract:According to the explorative case study with grounded theory based on interview and secondary data from two business groups, the non-archetypical patterns are extensive in practices. They are constructed and selected through the extent of centralization/decentralization by evaluating corporate value, synergy effect and control fitting of each subsidiary, which make centralization/decentralization as mediator in this mechanism. Besides, there are two new archetypes that emerge from case data including core-resources control and investment control, which are complementary to the "Trichotomy". Then a theoretical model of continuum of control patterns is constructed, which improves the construction and selection mechanisms of non-archetypical patterns.

      Abstract:This paper analyzes the relationship between the ownership structure and corporate performance. Manufacture industry corporate data from 2012-2015 are used to test the hypotheses in this paper. The results show that:high ownership concentration in growth and decline stage is good to corporate performance, while in mature stage a relatively concentration but with appropriate balances of ownership is good to corporate performance.

      Abstract:Since the implementation of the reform and open policy, SCI has entered China as a quantitative evaluation method for natural science journals, and then CSSCI has emerged in the field of social sciences in China. With the improvement of the level of scientific research in China, the shortage of simple quantitative evaluation method is becoming more and more obvious, and the SCI/CSSCI developers have being entangled in the selection of data development or journal evaluation. Therefore, using more scientific and reasonable methods, i.e., combining quantitative analysis with qualitative assessment, is an effective way to make up for the deficiency of SCI and CSSCI as evaluation tools. The fuzzy comprehensive evaluation model, which is established by means of four indexes involving the amount of paper downloading, SCI zoning, impact factors, academic influence, leads to the quantifiable evaluation of SCI journal papers. In the evaluation of journal papers in the field of social sciences, in recent years, there has been the exploration in "evaluating an author by papers" and then in "evaluating a journal by papers". Based on the normalization and consistency test, the scientific evaluation of CSSCI journal papers can be realized, which can avoid "evaluating a paper by journal" and make the evaluation of a journal paper more scientific, reasonable and executable, and then returning to paper standard and scholar standard in academic research.

      Abstract:The study on economic mechanism of Western academic periodicals can break through the bottleneck of domestic academic periodicals and has significance of realizing "going global" strategy. Its main research methodology is literature organizing, documents categorizing, basic economic methodology, and dialectic unification of Marx doctrine. Research results show that "economic mechanism of academic periodicals" is an internal unity of interdependent and interdisciplinary relationship formed in the process of article organizing, reviewing, editing and printing. Academic periodical operating includes its profit generating, cost spending, input and funds from government and social organizations. Profit generating consists of revenue from ads, publication, page charges, sales of right to use articles and conference, etc. Input in academic periodicals of Western governments and non-governmental organizations includes publication funds from financial allocation, government funding and subsidy, tax deduction, low-interest government loans and posting fees, as well as various funds from social and non-governmental organizations. Economic expenditure of academic periodicals consists of manpower cost on editing, office expenses, fees paid to distributors, using and depreciation of fixed assets, manufacturer printing cost and posting fee. WTO regulations appeal to publications' economic return and opening up access to periodicals funding, which makes an internal element of economic mechanism of academic periodicals. The conclusion is that, the above mentioned elements and components of economic mechanism of Western academic periodicals do not result in the market activity on academic periodicals with an exchange purpose. However, there are many non-commercial economic activities aiming at spreading academic achievements, for economic mechanism can be non-commercial. The above economic activities of Western academic periodicals are neither market activities nor capable of generating market mechanism. Thus, Western academic periodicals do not bear merchandise property and economic mechanism of Western academic periodicals is accordingly instructive.

      Abstract:Trust circulation of land management right involves the revision and perfection of many laws and regulations, which should be integrated systematically by Land Management Right Trust Rules. Firstly, it should carry forward the spirit of contract and trust culture, and maintain the fairness, stability and predictable nature of land management right trust. Secondly, it should strengthen the trustee's fiduciary duty and the defaulter's liability, and clarify the criterion of violation of duty of loyalty and duty of care. Thirdly, it should clear up the boundary of the beneficiary's right so as to strengthen his right to know, right to return and right to supervise. Finally, it should improve the trust registration rules of land management right so as to enhance its public trust in public notification.

      Abstract:Cross-border crowd-funding ought to be the development trend when the domestic internet industry's scale development has come to the critical point. Presently China should build the legal mechanism of cross-border crowd-funding to prevent the awkward situation of practice starting off before legislation. The major problem to build the legal mechanism of China's cross-border crowd-funding is that there has been no transcendent legislations of other countries and regions, the legal nature of crowd-funding's noumenon is not quite sure, the credit investigation system has not been integrated with the international community, and the development of cross-border internet financial regulation mechanism is immature. We can carry out concerning foreign crowd-funding business in China and carry out cross-border crowd-funding of donation to carry out cross-border crowd-funding business increasingly. Meanwhile, we should accelerate the speed of building the legal mechanism of cross-border crowd-funding to realize legislation's supply-side guiding function to practice.

      Abstract:Lehre vom fakultatives Kollisionsrecht, put forward by A. Flessner and given a detailed description by Th. M. De Boer, regards that paying attention to procedural interest of the parties should be one of the yardsticks to affirm the applicable law, even applying lex fori. This theory seems to contradict the most significant relationship principle and the lex fori principle of traditional international private law theory. In fact, they can blend well and complement each other, and can provide theoretical support for improving and enriching China's foreign civil and commercial judicial practice.

      Abstract:China has established the anti-dilution system of well-known trademarks in judicial practice. Confusion theory is used to protect well-known trademarks based on cross category confusion. The association theory attaches great importance to the interests of the trademark holders and emphasizes the "absolute protection", regardless of the possibility of confusion. The association theory is not enough to prove the rationality of trademark anti-dilution protection, and it is proved by the theory of free riding and other theories. The legislation of anti-dilution of well-known trademarks in China is wavering between the association theory and the confusion theory, which leads to the confusion in law enforcement and judicature. The free rider theory has proved the rationality of anti-dilution protection of well-known trademarks from the perspective of total social welfare. But the better way is to translate social cost into private cost, rather than by way of administrative and judicial power, to avoid association and dilution, and to avoid expanded application of anti-dilution of well-known trademarks.

      Abstract:Market priority principle is a principle to deal with the relationship between market forces and state intervention. Under the guidance of this principle, the state's intervention in economic activities should be restrained. State intervention should be based on market failure. Intellectual property system is a kind of special property right which is constructed by the state power. In the design process of the intellectual property system, we should take the market priority principle as the instruction, in order to facilitate the intellectual product market transaction as the principle to define intellectual property rights. In the exercise of intellectual property rights, we should rely on market forces to the greatest extent to allocate intellectual property rights. Restrictions on intellectual property rights should be compatible with the size and causes of market failure. When state forces intervene in the market transactions of intellectual property, it should be based on the judgment that the state force is more effective.

      Abstract:At present, there are two different viewpoints on the relationship between personal information property right and personal right, namely "monism" and "dualism". The transferability of personal information property right is obviously different from the personal specificity of personal right, and therefore personal information property right should be confirmed independently. Personal information property right can be exercised independently, which forms a right level, namely "personal information personal right-personal information property right-personal information using right", to safeguard the legitimate interests of related right holders in commercial use. The "externality" meanings to personality in different personal information types are different. Independent protection of personal information property rights will be propitious to realize the balanced value of protection of human dignity and freedom of information. Therefore, it is essential that we take the duality pattern namely independent confirmation, exercise and protection on personal information property right, in order to protect the most efficient personal information allocation through market and promote the commercial use in an orderly manner in the information age.

      Abstract:Civilization is a matter of practice. Different views of civilization shape different world order. The order of the world has been deeply influenced by the concept of Western civilization since modern times, especially the central theory of Western civilization.       Abstract:In constructing "double first-class" universities with Chinese characteristics, it is necessary to analyze the logical basis of running a school in China from the perspective of academics, in order to find an effective construction path. On the basis of investigating the historical rule of the rise of foreign universities to world-class universities, it is believed that the inheritance of outstanding national culture is the deep-rooted gene of building a "double first-class" university with Chinese characteristics.
