Abstract:With China running on the track of high-quality economic development, it is a vital institutional guarantee to accelerate the formation of a green financial policy system. This paper constructs a framework of the subjects, modes and goals of green finance, together with the influences on the high-quality economic development.The evaluation index system of green finance and high-quality economic development have been built, with the secondary indicators measuring green credit, green securities, green investment, green insurance, carbon finance and efficient economic development, stable economic development, optimization of economic structure, green economic development and economic innovation development, etc.By using the principal component analysis method to synthesize the comprehensive level of green finance development and the comprehensive index of high-quality economic development, the paper further makes an empirical test of the effects of green finance on the high-quality economic development with the panel data of 30 provinces from 2008 to 2016. The result shows that, comprehensively, green finance improves the overall comprehensive level of high-quality economic development, with the influence coefficient of 0.2814; specifically, green finance enhances green economy, optimizes economic structure, promotes innovation whereas escalates economy fluctuations and plays an insignificant role in the efficient economic development, with the economic green development effect (0.5870), economic structure optimization effect (0.2759) and economic innovation development effect (0.1126) respectively. This reflects that green finance has a good effect on improving the ecological environment, but needs to be strengthened in adjusting the economic structure and supporting green technology. The green finance policy is still yet to cope with industrial development, otherwise it might affect the economic stability, reducing the efficiency of economic development.Therefore, relevant innovations on green financial policies are suggested to promote high-quality economic development in the future. That is, the reform of green financial policy shouldfocuse on the establishment of green financial performance evaluation institutions in order to evaluate the implementation effect of green financial activities; Formulate the catalogue and list of green industries to promote the optimization of economic structure with the development of green industries; Encourage all green financial participants to promote green technology innovation, so as to promote economic innovation and development. The study has an important reference for clarifying the theoretical relationship between green finance and high-quality economic development, evaluating the impact effect and how to innovate green finance policies to comprehensively improve the level of high-quality economic development.

Abstract:In recent years, the phenomenon of "commodity financialization" has been widely concerned in the academic circle, and the stability of the financial market faces many challenges under the new development pattern of "dual circulation". It is of great significance to explore the risk prevention of the financial market from the perspective of commodity financialization to maintain the stable operation of the economy. Firstly, this paper systematically clarifies the influential mechanism of commodity financialization on the stability of Chinese financial market under the new development pattern of "dual circulation". Meanwhile, based on the improved commodity futures pricing model, the marginal effect of the impact of commodity price, supply, and demand on financial market stability are analyzed in detail from the perspective of financialization, and the heterogeneous characteristics in the long and short term, as well as market volatility environment, are compared. Secondly, using the samples of the US financial market from 2000 to the first quarter of 2020 and the Chinese financial market from 2010 to the fourth quarter of 2019, we construct the financialization index and the financial market stability index respectively, and empirically investigate the structural relationship among the financial market stability, commodity price and the degree of financialization through the structural vector autoregression model. Finally, considering the differences in market volatility, especially the impact of "black swan" events of uncertainty such as financial crisis or COVID-19, the threshold effect of the impact of commodity financialization on financial market stability in different market environments is empirically tested. The results show that in the short term, financialization has the greatest impact on the temporary shocks of commodity prices in commodity index markets of both China and the US, and the price level can be restored to equilibrium in each market within 1 to 2 years after the shocks; Financial market stability is significantly affected by commodity financialization, especially in commodity index markets; compared with commodity supply, demand and price, financial market stability is dominated by the degree of commodity financialization in the short term; commodity financialization has a more significant and deeper negative impact on financial market stability in the short term than in the long term; in the long run, financial market stability is dominated by commodity prices, while the impact of commodity financialization is weak; furthermore, the threshold model proves that the degree of commodity financialization has a stronger influence on the short-term stability of financial markets in a high-volatility environment than in the lower one. Accordingly, this paper puts forward the following policy suggestions for Chinese growing commodity futures market: firstly, optimize the system of commitments of traders in the commodity futures market, and strengthen the position identification of financial traders and the monitoring of commodity financialization; Secondly, regulate investors’ positions in an environmentally dependent manner, avoid the "one-size-fits-all" position restrictions, manage financial speculation in the market based on the differentiated policies; thirdly, establish a financial market linkage emergency response mechanism, improve the efficiency of risk identification in the financial market, prevent the spread of financial risks across the market, properly respond to the phenomenon of commodity financialization, and maintain the long-term stability of the financial market.

Abstract:Corporate culture has a guiding and restrictive role in corporate strategic choices and business decisions. Corporate corruption culture may distort corporate strategic choices and business decisions. The influence of corporate corruption culture on corporate technological innovation is therefore worthy of further study. Basing on literature, the paper firstly performs a theoretical analysis to find that since local governments in China control the key resources needed by enterprises, in order to obtain the competitive advantage, enterprises can not only enhance their own capabilities through innovation activities, but also obtain government resources through rent-seeking activities. However, due to their limited resources, enterprises can only choose between innovation activities and rent-seeking activities. Corruption culture makes enterprises tend to engage in rent-seeking activities by enhancing their preference for rent-seeking activities and reducing their costs of rent-seeking activities, thereby inhibiting technological innovation of enterprises. The paper then takes Chinese listed companies from 2007 to 2017 as a research sample to empirically investigate the real impact of corporate corruption culture on corporate technological innovation. We construct a corporate corruption culture measure based on culture background information of firm executives, and use corporate R&D inputs as the main indicator of corporate technological innovation. On this basis, this paper initially uses a panel two-way fixed-effects model, and then uses the mean value of corruption culture in other companies in the same industry as an instrumental variable for corporate corruption culture to perform two-stage least squares regressions to control potential endogeneity bias. The regression results show that corporate corruption culture significantly inhibits corporate technological innovation at least at the level of 5%. This result is robust to different dependent variables and sample groupings. Further research shows that there is still heterogeneity in this effect: corporate corruption culture in politically connected enterprises has a more significant negative effect on corporate technological innovation because the rent-seeking costs of politically connected enterprises are lower, so they are more inclined to profit from rent-seeking activities rather than innovation activities. In areas with better protection of intellectual property rights, the negative impact of corporate corrupt culture on corporate technological innovation appears weaker because a sound intellectual property protection system can improve the income of enterprises’ innovation activities. The research findings of heterogeneity also verify the mechanism proposed by above theoretical analysis: the trade-off between innovation activities and rent-seeking activities of enterprises due to their own limited resources. Based on the above research, we put forward policy recommendations such as cultivating Incorruptible culture, accelerating the marketization of factor allocation, strengthening intellectual property protection, and promoting technological innovation of enterprises. The paper for the first time investigates the impact of corruption culture upon corporate innovation, therefore enriches literature about economic consequences of corruption and determinants of corporate innovation.

Abstract:Under the background of service value co-creation, customer citizenship behavior in service settings becomes an important source for enterprises to obtain competitive advantage. Previous studies have revealed the importance of customer citizenship behavior in service activities, however, most of them explain the source of customer citizenship behavior based on customer satisfaction in physical product marketing, or study customer citizenship behavior from the perspective of relationship quality in service marketing. There is little research on the antecedent factors and mechanisms of customer citizenship behavior in mass service environment from the perspective of service interaction quality. Based on the theory of positive psychology, this study examines the relationship between different types of service interaction quality (interpersonal interaction and environmental interaction), customer experience quality and citizenship behavior intention in mass service environment, proposes and tests the theoretical model that two types of service interaction quality affect customer citizenship behavior through customer experience quality. In this study, the services of amusement places with group participation and interaction behaviors (including various large and medium-sized cultural theme parks, indoor amusement parks, movie theaters, home parties, etc.) are used as the research background. The sample data of 314 adult customers from 24 public amusement service institutions of different brands are obtained by on-the-spot questionnaire survey. The empirical analysis shows that: First, both interpersonal interaction quality and environmental interaction quality have a positive impact on customer experience quality and customer citizenship behavior intention in mass service environment, but the impact of interpersonal interaction quality is stronger than that of environmental interaction quality. Previous studies have not distinguished the differences in the quality of interpersonal interactions and environmental interactions and explained the specific effects. This study and its results are an extension and deepening of previous studies on the impact of service interaction quality. At the same time, the findings raise practical questions for companies that are increasingly reducing the number of front-line service employees and service contacts in order to reduce labor costs. Second, the study proposes and tests the way that two types of service interaction quality influence customer citizenship behavior through customer experience quality, and verifies that customer experience quality plays a partial mediating role in the influence of interpersonal interaction quality and environmental interaction quality on customer citizenship behavior intention, which is helpful to enrich the path and mechanism research of the customer citizenship behavior in service industry. Third, customer-firm identity is included into the research model as an individual psychological characteristic variable, and it is proposed and confirmed that customer-firm identity plays a complementary moderating role in the influence of customer experience quality on customer citizenship behavior. This result is not noticed in the previous literature research, which is conducive to a better understanding of the formation and change of customer citizenship behavior in the context of service interaction. This study provides new insights for exploring new antecedent factors and paths of customer citizenship behavior in the context of mass service.

Abstract:It contributes to rural revitalization strategy by improving the financial services, especially promoting farmland mortgage loans actively and steadily that deepen the organic connection between rural land assets and financial resources continuously. An in-depth exploration into farmers’ interpersonal financial literacy acquisition circle sources and the land loss risk perception factors has great significance to improve the system construction related to farmland mortgage loans. Firstly, this article theoretically explains the impact of financial literacy acquisition circles and land loss risk perception on farmers’ farmland mortgage loans participation, and then analyzes the mediating mechanism of farmers’ land loss risk perception. Secondly, the financial literacy acquisition circles are measured by factor analysis method, and four factors are extracted and defined as kinship circle, friends circle, neighborhood circle and institutional participation circle. Finally, Logit model and Bootstrap method are employed to empirically analyze the impact of financial literacy acquisition circles and land loss risk perception on farmers’ farmland mortgage loans participation and reveal the type and value of mediating effect of land loss risk perception, based on survey data collected from 1312 farm households from the pilot areas in Shaanxi, Ningxia and Shandong Provinces. The results show that financial literacy acquisition circles positively affect the farmers’ farmland mortgage loans participation significantly, in which the promotion of kinship circle is greater than institutional participation circle. Financial literacy acquisition circles negatively influence the farmers’ land loss risk perception, in which institutional participation circle has the greatest impact, kinship circle is next, and friends circle is the last. Land loss risk perception plays a negative role in the participation of farmland mortgage loans in all the four financial literacy acquisition circles. Land loss risk perception has a part mediating effects on the relationship between financial literacy acquisition circles and farmland mortgage loans participation with a size of 0.2112. Specially, with financial literacy acquisition institutional participation circle, farmers’ land loss risk perception exerts the greatest mediating effects with a size of 0.2231 partly. The next is land loss risk perception with kinship circle exerts part mediating effects, and the size is 0.1018. Farmers’ land loss risk perception does not exist mediating effect with the neighborhood circle. However, land loss risk perception with friends circle plays suppressing effects, the size is 1.8511, indicating that there are other mediators with more effects. Therefore, this article puts forward the following policy recommendations: First, farmers need to build, maintain and develop a multidimensional financial literacy acquisition circles based on kinship circle and institutional participation circle, and enrich friends circle and neighborhood circle as the source of financial literacy acquisition. Secondly, farmers should optimize kinship circle by strengthening communication and enhancing trust, improve friends circle and neighborhood circle by enhancing mutual assistance and knowledge sharing, and financial institutions should improve farmers’ financial literacy by carrying out propaganda and strengthening contact. Thirdly, the government and financial institutions should pay more attention to the possible risks arising from the pilot loans, reduce farmers’ overestimation land loss risk, and accelerate the innovation of the farmland mortgage loans risk prevention mechanism.

Abstract:The implementation of rural revitalization strategy aims at developing rural economy and increasing farmers’ income. It is of great significance for the implementation of rural revitalization strategy and the stable development of social economy to alleviate the income gap of rural households. At the same time, the rapid development of Internet technology has brought profound changes to social life and played a decisive role in the process of economic development. The development of Internet economy has a far-reaching influence on efficiency and equity, and profoundly changes the formation mechanism of income inequality in rural China. So, can internet technology reduce the income gap of farmers while increasing their income? It is of great significance to clarify the mechanism of the impact of Internet use on the income gap of rural households in order to give full play to the positive role of the Internet, and promote rural development. Based on the survey data of CGSS in 2015, this paper studies the impact of Internet use on the income inequality in rural China by using the method of recentered influence function regression (RIF). The results show that: firstly, Internet use has significantly expanded the income inequality in rural China, and when the education level of farmers is higher, the effect of Internet use on income gap is more obvious, and the conclusion is still valid after the robustness test. Secondly, the impact of Internet use on the income inequality in rural China is heterogeneous. In areas with higher Internet development, social trust and marketization, the effect of Internet use on the expansion of the income gap of rural households is more significant. After examining the impact of individual characteristics, it is found that when the education level of rural households is higher, the effect of Internet use on the expansion of the income gap is more significant Thirdly, after further analyzing the process of Internet use affecting the income inequality in rural China, it is found that the return rate and frequency of Internet use of high-income farmers are significantly higher than that of low-income farmers. The main contributions of this paper are as follows: 1) Based on the "Digital divide" brought by the popularization of Internet, this paper discusses the impact of Internet use on the income gap of rural households, which provides a new perspective for understanding the expansion of the income gap of rural households, and expands the research scope of the income gap theory; 2) Based on the regional differences and institutional environment, this paper explores the heterogeneous impact of Internet use on the income gap of rural households, and provides new empirical evidence and decision-making basis for further widening the income gap of rural households; 3) It is helpful to understand the internal mechanism of the difference of Internet use from the perspective of difference of access and difference of return.

Abstract:The right to speak in Chinese social science academic journals is an integral part of the right to speak in China’s national image in the new journey of Chinese-style modernization. Since the 18th National Congress of the Communist Party of China, the issue of the right to speak has gradually been put on the national agenda, showing an increasingly important position and role. At present, there are some deviations in the practice and research of the discourse power of academic journals, which need to be deepened from the three aspects: communication, guidance and influence.The right to speak in Chinese academic journals of social sciences has its own uniqueness. The first is the ideological orientation on the main body,the second is the characteristics of channels and languages in communication, the third is the characteristics of evaluation and dialogue in influence, and the fourth is the characteristics of problems and plans in guidance. These characteristics determine the characteristics of the right to speak in Chinese social science academic journals, which will mainly focus on domestic "internal circulation" and supplemented by international "external circulation".The current situation of the right to speak in Chinese social science academic journals is that in terms of communication, the communication power of a single journal is weak and the database is the main model. In terms of guidance, the domestic guidance power is strong and the international guidance power is weak. In terms of influence, a large number of Chinese social science academic journals have emerged with high domestic impact factors and low international impact factors. To enhance the right to speak in Chinese social science academic journals, in terms of communication power,the first is to continuously optimize the main channel of database communication, the second is to do a good job in strengthening the social communication of integrated media, and the third is to explore and deepen the communication of clustered communities; In terms of guiding power, one is to guide the direction of academic research through topic setting, the second is to guide the academic research paradigm through normative setting, and the third is to guide the integration of academic research through discourse setting; In terms of influence, from a qualitative point of view, it is evaluation, reading preference and word of mouth, and from a quantitative point of view, it is a series of data-based impact factor indicators.under the strong leadership of the Party, the construction of the right to speak in Chinese social science academic journals should solve Chinese problems with academic achievements of creative transformation and innovative development, answer the questions of the times, highlight the Chinese road, and form an "external circulation" discourse power of international social science academia that matches China’s comprehensive national strength and international status on the basis of the "internal circulation" right to speak in Chinese social science academia.

Abstract:To improve the current academic environment, in recent years, the Chinese authorities have issued a series of policy documents on academic journal construction, academic evaluation, scientific research evaluation and talent evaluation. Open science development strategies and operational platforms have flourished around the world, and scientific communication models and scientific research paradigms have undergone changes and transformations as a result. In the open science environment, academic journals, as important carriers of academic communication and an important part of academic communities, play an increasingly important role in the construction of disciplinary systems, academic systems and discourse systems. Chinese academic journals are an important position for interpreting Chinese practice, constructing Chinese theories, promoting Chinese schools of thought, and competing for and enhancing China’s international academic discourse. Meanwhile, in the open science environment, the transformation of scientific exchange and research paradigm urgently needs diversified and open scientific evaluation. This paper aims to enrich and improve the evaluation theory and index system of the discourse power of academic journals with Chinese characteristics, boost the construction of academic journals and the reform of quantitative evaluation mechanisms, and provide a reference for promoting the international discourse power of Chinese academic journals. Based on the theory of evaluation science, discourse power theory and communication theory, this paper discusses the basic issues of the discourse power evaluation of academic journals, integrates multi-source heterogeneous data, and adopts correlation analysis and integrated factor analysis, entropy weight method, TOPSIS method and two-dimensional mapping method to conduct empirical research from the perspectives of multi-factor, multi-indicator, multi-method fusion, comparison and evaluation. It defines the academic discourse power and the discourse power of academic journals. It is proposed that the discourse power of academic journals is composed of discourse influence and discourse leading. Discourse influence is composed of discourse influence ability and discourse power, and discourse leading is composed of news discourse, social media discourse, peer review discourse, encyclopedia discourse, video discourse and policy discourse leading. This paper explores the formation process of the discourse power of academic journals, constructs the discourse power evaluation model of Chinese academic journals in English. The results show that the research on discourse power evaluation of academic journals based on the theory, method and application logic is practical, comprehensive and reliable. Chinese academic journals influence and lead the ideology, academic terminology and academic vane of academic research, while being highly Chinese style, Chinese manner and Chinese characteristics. Chinese academic journals should serve as important spokespersons for Chinese academic discourse and contribute to accelerating the construction of the "three systems" and enhancing China’s international academic discourse.

Abstract:In the critical period of the national rejuvenation strategy within the wider context of the once-in-a-century changes taking place in the world, China should not only further integrate itself into the international arena, but also contribute Chinese wisdom and Chinese solutions to global governance. Such practical needs promote the academic community to tell Chinese stories well and form an academic discourse system with Chinese characteristics, Chinese style and Chinese style. Constructing academic discourse system with Chinese characteristics is an urgent need to tell Chinese stories well, build Chinese independent knowledge system, enhance Chinese cultural confidence and enhance China’s international academic discourse power. As an important platform for publishing academic research results, academic journals are important subjects to promote the construction of academic discourse system with Chinese characteristics. However, the current research has not paid enough attention to the important role of academic journals and academic communities in constructing the academic discourse system with Chinese characteristics. Therefore, in the critical period of accelerating the construction of academic discourse system with Chinese characteristics, promoting the integrated development of academic journals and academic communities has become an important issue that cannot be ignored. Academic journals and academic communities have inherent coupling, that is, academic journals need to integrate into academic communities, and academic communities cannot be separated from academic journals platform. The integrated development of academic journals and academic communities has practical feasibility, which shows that academic journals can effectively promote the formation and development of academic communities, and academic communities can enhance the influence of academic journals. The heterogeneity of academic journals, the imbalanced distribution of academic resources, the excessive intervention of administrative power in academic business, and the difference of research interests of academic communities are the important factors that affect the integrated development. Therefore, to promote the integrated development of academic journals and academic communities, the relationship between different organizations should be integrated at the demand level to enhance the effective demand of subject groups. At the supply level, an academic platform based on the demand of academic discourse system with Chinese characteristics should be constructed. At the institutional level, the peer review system and the academic resources distribution system should be improved. At the technical level, the application of big data should be taken as the core means to improve the synergy between organizations.

Abstract:The increasing popularity of the online manuscript submission system has brought great convenience for authors to submit manuscripts and expert reviewers, and improved the efficiency of editing and publishing work and the transparency of manuscript processing. However, it also provides convenience for the occurrence of academic misconduct such as "multiple submissions". Academia and publishing workers pay more attention to and research on "multiple submissions", but the phenomenon has not attracted the attention of researchers, and there is little attention and research in academic circles. In fact, the phenomenon is becoming more and more serious. This paper takes three academic journals as research cases, and discusses the submission characteristics of "multiple submissions" papers in the online manuscript submission system of academic journals, to enhance the screening and prevention of "multiple submissions", and to attract the attention of academic journals and editors to "multiple submissions" papers and reduce the negative impact of such papers on journal editing and publishing. Through the query and statistics of all submissions in thethree journals’ online submission system from January to December 2020, a total of 2664 "multiple submissions" papers are obtained. This paper summarizes the characteristics of "multiple submissions" papers according to the author’s e-mail username format, the same author registering multiple usernames, etc. This paper discusses the occurrence logic of "multiple submissions" papers from the perspectives of the bad orientation of "thesis-only" in talent evaluation, the development of network technology and the imperfection of submission system, and the authors’ own utilitarian scientific research mentality. This paper analyzes the negative impacts of "multiple submissions" from the perspectives of creating a "bubble" of manuscript sources, wasting journal publishing resources, risking "multiple submissions" or even "multiple publications", being not conducive to the acceptance of manuscripts, and delaying the author’s publication progress. In order to reduce the adverse effects and harm of "multiple submissions", corresponding governance measures are proposed from the perspective of multi-subject collaborative governance. Universities and scientific research institutions should get rid of the bad orientation of "thesis-only" and establish a more scientific and reasonable talent evaluation system. Authors should raise their awareness, recognize the adverse effects of "multiple submissions", and take the initiative to eliminate "multiple submissions". Editors should be more vigilant, give full play to their subjective initiative, and effectively identify "multiple submissions". Journals should strengthen system maintenance and website management, and prevent "multiple submissions" from technical upgrades and management systems. Government departments should increase punishment of intermediary agents for papers, and purify the atmosphere of academic research. Only when all relevant subjects improve their ideological understanding, take the initiative to act, and take multiple measures to form a system synergy and improve governance efficiency, can they effectively prevent and even completely eliminate "multiple submissions", create a good academic ecology, and better promote academic journals healthy and sustainable development.

Abstract:As for the similarities and differences between the capital circulation theories of Das Kapital and Tableau Economique, there have been two views in the academic circle, namely, "the theory of similarity" and "the theory of transcendence". However, there are obvious defects in these two views: "the theory of similarity" emphasizes more the similarities between Marx’s and Quesnay’s capital cycle theories in "research methods", "internal logic" and "practical applications", while ignoring the theoretical views formed by Marx’s criticism of Quesnay; "the theory of transcendence" emphasizes more on the differences between the two scholars’ academic positions, as well as the resulting differences in the capital cycle theory. The two views do not fully reflect the similarities and differences between Das Kapital and Tableau Economique in the theory of capital circulation. After comparing the capital cycle theories of the two from the perspective of "main viewpoints" and "methodology", this study finds that the capital cycle theories of Das Kapital and Tableau Economique show the coexistence of "similar main viewpoints" and "different methodologies". Through in-depth analysis of this unique academic phenomenon, it is found that there are still many similarities in the main points of view of the capital cycle theory of Das Kapital and Tableau Economique when the methodology is different. The main reason is that Marx and Quesnay both experienced the link of "economic relationship" analysis when investigating the capital cycle problem. However, as Marx and Quesnay have different understandings of "general labor" and "natural order", there are fundamental differences between the two capital circulation theories. Although he has repeatedly agreed with Quesnay’s theory of capital circulation, Marx has also realized that his own theoretical views are different from those of the Tableau Economique, but due to the influence of subjective and objective factors, Marx has not fully demonstrated his theoretical differences with Quesnay on the issue of capital circulation in subsequent studies. Through the comparison of the two capital circulation theories, we can also see that the unity of "main viewpoints" and "methodology" is the attribute of Marxist economic theory. This theoretical attribute also affected Marx’s absorption and criticism of the capital cycle theory of other economic schools and economists in the same period. Abstract:After the Qing Dynasty unified China, there was a peaceful and stable situation and the prosperity and development of the economy and society, and the population was rapidly recovered and increased. During the Kangxi Period, the Chinese population broke through 100 million, and by the peak stage of population growth in the middle and late Qing Dynasty, it exceeded 400 million. Therefore, the Qing Dynasty also became the historical period with the largest population in ancient China. The substantial population growth has led to the increasingly prominent problem of food supply. In order to save food to meet the needs of the new population to maintain their livelihood, the early Qing Dynasty (mainly the three dynasties of Kang Xi, Yong Zheng and Qian Long) proposed a strict alcohol prohibition policy and issued relevant laws. In addition, the Qing Dynasty was a period of frequent disasters in China, which led to the emergence of prohibition laws in the early Qing Dynasty marked by "prohibition of alcohol due to disasters". However, the proposal of the alcohol prohibition decree also caused great repercussions within the Qing government, forming a clear division of supporter and opposition of the alcohol prohibition decree, and launching a fierce debate about whether to implement the alcohol prohibition policy. Although most emperors, as the supreme ruler, supported and carried out the policy of prohibition against alcohol, these prohibition laws were greatly discounted by officials at all levels in the actual implementation process, and were basically unable to be implemented. The reason is that, on the one hand, it is affected by the basic formation of the nationwide drinking custom, especially that alcohol has become a necessary consumable in daily social life and the consumption is huge. On the other hand, it is due to the practical impact of the alcohol industry as an important driving force of local economic development, because the production of alcohol can improve the market economic value of food crops, and can also drive the development of related industries, providing more opportunities for people to maintain their livelihoods and increase their income. Therefore, many local officials, proceeding from reality, pointed out that the production and sales of alcohol not only are the basis for many people to live on, but also promote the development of local economy. Therefore, they do not agree to implement such a strict alcohol prohibition policy. Objectively, as an irreplaceable daily consumer product with addictive consumption characteristics, alcohol has played an irreplaceable role in important ceremonies, commemorative activities and festivals. It has become an important consumer product that cannot be separated from people’s daily life. The prohibition policy simply because of food wasting or dealing with famine is unreasonable and impractical.

Abstract:Lu Xun is an outstanding novelist in the history of modern Chinese literature, the sense of picture formed by the novel language is one of the important marks of his works. The sense of picture is the product of the organic integration of Lu Xun’s painting art and novel language, it is also the meeting point of Lu Xun as a "writer" and an "artist", and also the new perspective of the research of Lu Xun. Lu Xun creatively combined literary thinking with artistic thinking, applying the creative concepts and techniques of line drawing, woodcut, ink painting and cartooning to his novels, so that the language of his novels presented a sense of picture with different artistic styles. Among them, the precise and vivid pictures drawn in line drawing are the manifestation of realism, the profound and grim pictures formed by the taste of woodcuts are the "beauty of force" of modernism, the poetic freehand pictures created by the tone of ink painting styles contain the aesthetic charm of Chinese classicism, and the exaggerated symbolic pictures practiced in comic drawing styles are tongue in cheek and expressiveness of postmodernism. The sense of picture brought by novel language is a precious wealth left by Lu Xun to Chinese modern and contemporary literature. Abstract:Discipline inspection and supervision as a first-level discipline contains unique theoretical logic, which is also the theoretical support for its standing under the category of law with other first-level disciplines. At the institutional level of discipline inspection and supervision, on the whole, it has gone through the "discipline inspection" stage dominated by intra-Party supervision, the "supervision" stage in which intra-Party supervision and administrative supervision are parallel, and the "discipline inspection and supervision" stage in which intra-Party supervision and state supervision are integrated. The development context of the three stages clearly presents the general trend of the development of discipline inspection and supervision, that is, the integration of discipline inspection and supervision. The evolution of the system from "discipline inspection" to "supervision" and then to "discipline inspection and supervision" reflects the growing maturity of the concept of national governance with the joint efforts of the Party and the law, laying the foundation for the discipline construction of discipline inspection and supervision. Discipline inspection and supervision, as a first-level discipline, has its special theoretical essence, theoretical significance and governance value. Abstract:The sudden emergence of digital economy has brought challenges to the order of rule of law, which is an important support for the governance system and governance capacity, and also created a brand-new demand for the rule of law. Facing the new "governance deficit", how to provide high-quality "legal products" and build a legal order that is conducive to the development and governance of digital economy has become a top priority. However, digital economy, as a newly emerging thing, is highly dependent on scientific and technological innovation, and is in the process of continuous innovation, development and change, with typical characteristics such as being innovative, border-crossing, virtual and platform-based. The unified rule of law supply from the central level faces many practical difficulties, and it cannot effectively activate the driving force for innovation and development of local digital economy. To this end, the central government adopted the Implementation Plan of the National Digital Economy Innovation and Development Experimental Zone, selected some places to carry out pilot projects on digital economy innovation, development and governance, and encouraged the pilot zones to strengthen institutional innovation and explore local laws and regulations. Against this background, the development of the rule of law in the digital economy, in addition to the central government’s unified promotion of the supply of basic legal systems such as the Personal Information Protection Law and the Data Security Law, has become an issue that has to be paid attention to, such as how it is possible for local governments to access part of the rule of law supply in theory, whether it has a realistic foundation in practice, what challenges it faces and how to overcome them. Based on this, this paper explores the theoretical basis and practical path of the experiment of rule of law in the field of digital economy by means of logical reasoning and empirical analysis. Research finds that the experiment of rule of law at the local level in digital economy is an empirical governance method that effectively responds to the demand of rule of law in digital economy. The theoretical logic lies in taking the whole country’s rule of law as the ultimate destination, taking the exploration of local digital rule of law as the method, paying attention to local trial and error and experience accumulation, taking the organic combination of "top-down" and "bottom-up" as the path choice for the construction of digital economy rule of law, and starting from the interests represented by the central and local governments in the development and governance of digital economy and the realistic difficulties encountered, to construct the rule of law pattern meeting the governance needs with Chinese characteristics. However, the right to create local rule of law granted by the Constitution and its related laws, the authorization and encouragement of the central government to the pilots and trials in innovation-driven development of local digital economy, and the accumulation of digital rule of law development experience of the "pilot projects" in some provinces provide a realistic possibility for a wider and deeper local law-based pilot in this field. Of course, this empirical rule of law path of digital economy also faces challenges such as the expansion of local digital rule of law boundary, local data protectionism, and single local digital governance mode. It needs to be limited by the principle of national legal unity, the goal of national unified market, and the construction of pluralistic co-governance pattern, so as to overcome the disadvantages in the rule of law experiment at the local level of digital economy and give full play to its advantages.

Abstract:The type of behavior stipulated in Article 253 of the Criminal Law of China on the crime of infringing on citizens' personal information is only limited to the transfer behavior represented by illegal acquisition, sale or provision of personal information, and the illegal use of personal information is not included in the scope of regulation, resulting in loopholes in the criminal regulation, which reflects the defects in understanding the legal interests of one-sided understanding of personal information autonomy as transfer autonomy and neglect of use autonomy. And then only preventing illegal transfer of personal information is taken as the logic of criminalization, making the criminal law protection of personal information legal interests incomplete. At present, personal information has become a key element in network crimes. The phenomenon of illegal use of personal information has become increasingly fierce. Crimes against citizens' personal information have gradually formed a complete black industrial chain of "provider-middleman-illegal use". Each link has a clear division of labor and strict organization, and illegal and criminal activities are carried out through illegal use of personal information. And then the realization of profits is the root cause of the widespread disclosure of personal information and the proliferation of illegal transactions. The criminal law can only crack down on the illegal transfer of personal information, which can only be a temporary solution, leading to poor criminal governance of crimes against personal information. As we enter the stage of deep mining and application of big data, the use value of personal, property, public and other composite legal interest attributes rooted in personal information has become increasingly prominent in context of the vigorous development of the digital economy, making the autonomy of personal information use more of a core legal interest status than the autonomy of personal information transfer. The focus of personal information criminal law protection should be shifted from the transfer link to the use link. The illegal use of personal information belongs to the downstream behavior, which causes great damage or threat to the personal and property safety of citizens and the social management order. Compared with the illegal transfer of personal information in the upstream, the illegal use of personal information has a more serious legal interest infringement, which is manifested in the root, directness and accuracy of legal interest infringement. Therefore, criminal legislation should be demand-oriented, and it is necessary to reasonably determine the incriminating elements and causes of decriminalization of illegal use of personal information on the premise of following the principle of modesty of the criminal law, that is, taking serious cases without the consent of information subject as harmful behavior, taking personal information that is not subject to anonymous treatment as the object of conduct, and taking the situation that conforms to the reasonable use of personal information as the cause of illegal obstruction. It not only standardizes the use of personal information from the source, but also limits the criminal boundary of illegal use of personal information. While protecting the security of personal information, it promotes the orderly and free flow, reasonable and effective use of personal information, balances the independent use interests of information subjects and the legitimate use interests of information processors, and provides a strong criminal rule of law guarantee for the high-quality development of the digital economy.

Abstract:The execution of specific objects is based on the principle of original object execution, but the damage of specific objects is inevitable in the process of execution. In terms of legislation, China paid attention to it as early as 1998 in the Provisions of the Supreme People’s Court on Several Issues Concerning Execution Work of People’s Courts (Trial). Since 1998, the mode of execution of damaged specific objects in China has evolved from "compensation at a discount or alternative execution" to "negotiation or separate action", and then to "negotiation or retrial or separate action". In terms of justice, the execution cases related to damaged specific objects also show a rising trend year by year. Although the legal exploration of China has gone through more than 20 years in the face of the execution of damaged specific objects, there are still problems related to execution of damaged specific objects. At present, there are still different demands of the parties, the enforcement agencies are in a practical dilemma, and there are also theoretical embarrassments of the coexistence and poor connection of multiple theories of the subject matter of enforcement, the subject matter of litigation, and the standard of res judicata. Although the newly issued Opinions of the Supreme People’s Court on the Coordinated Operation of the People’s Court’s Filing, Trial and Execution Work in 2018 introduced the time node of "the end of the last court debate", the new relief plan proposed by the Supreme People’s Court—"retrial or separate action" faces challenges such as lack of time setting, lack of consideration of specific damage elements, and unreasonable relief system. From the perspective of the causes of the problem, the problems of execution of damaged specific objects are due to the lack of continuity between substantive law and procedural law and the lack of deep understanding of the content framework of procedural law. In this regard, in combination with the implementation response mechanism framework of damaged specific objects at home and abroad, if we can strengthen the execution investigation, accurately grasp the specific object status, accurately realize the procedure diversion, improve the implementation method, and implant the spare execution and spare litigation, we can moderately alleviate or dredge the existing problems of the inability to execute damaged specific objects. However, the reality is that the judicial and executive relief judges have different theoretical positions concerning the execution of specific objects, and the legitimacy of forced connection in a unified model is even more insufficient, so this solution should be abandoned or improved. Under the background of multiple theories and multiple links, we should make use of the consistency and logical self-consistency of judges’ individual views and positions to reasonably allocate the right to initiate the review of execution. Through the implementation of the separation of trial and execution, the executive judge should be specialized in handling execution matters, and no longer intervene in the trial and relief judgment, so that the trial judge on which the execution is based can directly connect with the relief judge when the execution of specific objects is not smooth, so as to unify the theoretical positions of the trial judge and relief judge. It is the fundamental solution to the execution problem of specific object damage, which achieves a strong connection between trial and execution, and achieves a consistent effect in case handling.

Abstract:Although the civil execution procedure takes the realization of the obligee’s right as the main goal, the protection of the basic human rights of the person subjected to execution during the execution process should also be paid attention to. The two are the proper meanings of the modern human rights concept and jointly constitute the protection of human rights in the civil execution procedure. But the main mission of civil execution procedure determines the extent of the obligee’s realization of right and obligor’s basic human rights protection is always in a vulnerable "biased" dynamic balance state. With the enhancement in the execution of the obligee’s realization of right, it will gradually increase the tension between the two, and the fragile balance would be broken at any time. The Civil Execution Law (draft) is a summary of the experience and wisdom in civil execution judicial practice of China. One of the important measures for the dimensions of its legislative scientificity is the effect of realizing obligee’s rights, but this should not be taken to extremes. The protection of the human rights of persons subjected to execution should also be taken into account. Therefore, the Civil Execution Law (draft) must respond to the tense game and conflict between the realization of the obligee’s rights of the applicant and the protection of the basic human rights of persons subjected to execution in legislation and judicial practice. The right to equal protection principle, principle of proportionality and principle of procedural relief should play a full role of basic values in system construction. According to the protection of the right to survival, peaceful life, integrity of personality and personal dignity of the person subjected to execution, it can "draw" the limits of the effect of the execution power on the person subjected to execution. Based on this, the boundary of human rights protection of the person subjected to execution is clarified. Through balancing the value between the realization of the obligee’s rights and the protection of the basic human rights of the person subjected to execution, the Law of Civil Enforcement (draft) "inlays" the "kernel" of human right protection, and contributes to the construction of China’s human rights discourse system.

Abstract:City and countryside are an organism, and the urban and rural relationship is always an important relationship through the economic and social development process, also is a key question that China must pay high attention to in the process of socialist modernization construction. At present, China is experiencing the social transition of the new economic and social form. The integrated development of urban and rural areas has become an inevitable choice to realize Chinese-style modernization and move towards common prosperity for everyone. The most arduous and onerous task in promoting common prosperity lies in rural areas. To revitalize rural areas, we should not just talk about rural areas, but form a new type of relationship between workers, farmers and rural areas in which cities lead rural areas and industries promote rural areas. Exploring the theoretical logic and historical logic of urban and rural development, based on the consideration of urbanization construction and the current situation of urban-rural integration, it can be found that the urban-rural relationship development is based on the actual demand for emancipating the development of productive forces, to achieve the goal of the people’s livelihood. Since reform and opening up, especially since the 18th National Congress of the Party, China has made remarkable progress in overall planning of urban and rural development and promoting the new urbanization construction. We will break the barriers of the urban-rural dual system, actively promote the implementation of the strategy of integrated urban-rural development, strengthen rural infrastructure and digital development, break the traditional model of separate urban-rural development, and ensure equal access to public services for urban and rural development.
